1. Eligibility
You must be at least 18 years old to create an account or use Who's Out?. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.
Who's Out? is designed primarily for people in Ireland. Features that rely on maps, places, or local discovery may not work as intended outside Ireland.
2. Your account
- You are responsible for activity that occurs under your account.
- You must keep your email account secure, as we use email one-time codes (OTP) to sign you in.
- You may not create an account for anyone else without permission, impersonate others, or use another person's account.
- You agree to provide accurate profile information and to update it when it changes.
- One person should generally maintain one primary account, unless we expressly allow otherwise.
3. The Service
Who's Out? is a social discovery product that may include features such as Out & About status, Plan Invites, private and group messaging, map-based check-ins and discovery, friends, curated places with ratings and reviews, events, and related tools.
We may change, add, or remove features at any time. The Service may be unavailable during maintenance, outages, or updates. Early / TestFlight builds may be incomplete or change frequently.
4. Acceptable use
You agree not to misuse Who's Out?. Prohibited conduct includes, without limitation:
- Harassment, bullying, threats, stalking, or unwanted contact.
- Hate speech, discrimination, or content that promotes violence or illegal activity.
- Sexual content involving minors, or any exploitation of children — zero tolerance.
- Sharing others' private information without consent (doxxing).
- Impersonation, scams, phishing, or fraudulent behaviour.
- Spam, unsolicited commercial messaging, or deceptive promotions.
- Uploading malware or attempting to disrupt, scrape, reverse engineer, or abuse the Service.
- Using the Service while under 18, or helping a minor circumvent age restrictions.
- Using location features to track or locate someone without their knowledge or consent in a harmful way.
- Violating applicable laws, including Irish and EU law.
We may remove content, limit features, or suspend accounts that violate these rules — with or without prior notice when we believe safety or legal risk requires it.
5. Your content
You retain ownership of content you create and share on Who's Out? (such as messages, status updates, reviews, photos, and plan details). By posting content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content solely as needed to operate, improve, and promote the Service.
You are responsible for your content. You confirm that you have the rights to share it and that it does not infringe others' rights or violate these Terms.
Profile photos and certain other submissions may be subject to moderation before becoming visible. We may refuse, remove, or restrict content that violates these Terms or our community standards.
6. Our intellectual property
The Who's Out? name, logo, app design, branding, software, and related materials are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works from our intellectual property except as expressly allowed through normal use of the Service.
7. Safety and moderation
We provide tools such as block, report, and visibility controls to help you manage your experience. We review reports and may take action including content removal, warnings, suspension, or permanent bans.
We do not guarantee that we will review every piece of content in advance, or that the Service will always be free of harmful behaviour. If you feel unsafe, leave the situation, contact local authorities if needed, and report the user in-app or via support@whosoutapp.ie.
8. Location and accuracy
Many features depend on device location, maps, and third-party place data. Location can be imprecise, delayed, or unavailable. Venue names, distances, "who's nearby", and similar information are provided for convenience only and may be incomplete or incorrect.
Who's Out? is not an emergency service, safety tracker, or navigation system. Do not rely on it for medical, police, or rescue situations.
9. Third-party services
The Service relies on third parties (for example authentication, hosting, maps, and push notifications). Those services have their own terms and privacy practices. We are not responsible for third-party outages, changes, or policies beyond our reasonable control.
10. Suspension and termination
You may stop using Who's Out? at any time and may request account deletion by contacting support@whosoutapp.ie (or via in-app controls when available).
We may suspend or terminate your access if you breach these Terms, create risk for others, or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content (including user statuses, locations, or place information) will be accurate or complete. Meeting people in person involves inherent risk; use your judgement and common sense.
12. Limitation of liability
To the maximum extent permitted by applicable law, Who's Out? and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of (or inability to use) the Service.
Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us (if any) in the 12 months before the claim, or (b) €50.
Nothing in these Terms excludes or limits liability that cannot be excluded under Irish or EU law, including liability for death or personal injury caused by negligence, or for fraud.
13. Indemnity
You agree to indemnify and hold harmless Who's Out? and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms, to the extent permitted by law.
14. Changes to the Terms
We may update these Terms from time to time. We will update the "Last updated" date and may notify you in the app or by other reasonable means. Continued use after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the Service and request account deletion.
15. Governing law
These Terms are governed by the laws of Ireland, without regard to conflict-of-law principles. Courts in Ireland will have exclusive jurisdiction over disputes, except where mandatory consumer protections in your country of residence provide otherwise.
